As with music, software poses particular problems for copyright owners. By nature, it`s easy to duplicate, but unlike music, software is usually not used in places open to the general public. This poses enormous challenges for software copyright enforcement, given that so-called software application pirate applications accounted for between 10 and 40 percent of the software installed on a typical business computer. The problem is perhaps more prevalent in the consumer market. Since the transfer of knowledge between the parent company and the licensee is very present in this type of entry, the decision to enter into an international licensing agreement depends on the respect shown by the host Government for intellectual property and the ability of the licensor to choose the right partners and prevent them from competing in each other`s market. Licensing is a relatively flexible employment contract, which can be tailored to the needs and interests of both the licensor and the licensee. Here are the main advantages and reasons to use an international license for international expansion: due to the legal basis they must cover, some license agreements are quite long and complex. But most of these agreements cover the same fundamental points. These include the scope of the agreement, including exclusivity or territorial restrictions; financial aspects, including necessary advances, royalties and the calculation of royalties; guarantees for minimum sales; calendars with “to market” dates, contract duration and renewal options; the rights of the lessor to monitoring and quality control, including the procedures to be followed; the minimum stocks to be maintained; and returns and allocations. The USPTO is the federal authority responsible for intellectual property. In collaboration with the United States Copyright Office, they create and manage all laws and rules relating to intellectual property. Some believe that part of the solution to software licensing problems is for companies to implement sophisticated resource tracking systems that monitor the installed base of programs — perhaps in real time — and recognize when an unauthorized application has been installed. So far, there are few, if any, generally accepted tools, but this is an area of development that is probably supported by both software users and publishers.

Licensing agreements cover a wide range of known situations. For example, a retailer could enter into an agreement with a professional sports team to develop, produce and sell merchandise bearing the sports team`s logo. Or a small manufacturer may allow a production technology owned by a larger company to gain a competitive advantage instead of having to spend time and money developing its own technology. Or a greeting card company could agree with a movie distribution to produce a series of greeting cards with the image of a popular animated character. . . .
